HMRC TRIVIAL BENEFITS COMPLIANCE CHECKLIST

How HMRC Trivial Benefits Work:

Under HMRC guidelines, employers can provide small non-cash gifts to staff completely tax-free with zero Income Tax, zero National Insurance, and no P11D reporting requirements.

Max £50 Limit (Inc. VAT): The cost of the gift card must not exceed £50 per employee (including VAT) per occasion.

No Cash or Cash Vouchers: Must be provided as a gift card or e-voucher redeemable for goods/services, never cash.

Not Performance-Related: Must NOT be given as recognition for work performance, sales targets, or accomplishments.

Not Contractual / Salary Sacrifice: Cannot be written into employment contracts or funded via salary sacrifice.

Director Cap (£300/yr): Directors of close companies are capped at £300 in trivial benefits per tax year (e.g. 6 x £50 cards).

Trivial Benefits Gifting Occasions

Because trivial benefits cannot be linked to performance targets, use them to celebrate personal moments, boost morale, and say thank you throughout the year.

Birthdays & Personal Milestones

Surprise team members on their birthday, work anniversary, or personal achievement with a gift card.

Seasonal Celebrations & Christmas Perks

Spread holiday cheer at Christmas, Easter, or summer without adding to your year-end payroll tax liabilities.

Life Events & Employee Wellbeing

Mark housewarmings, new babies, weddings, or get-well-soon wishes with a thoughtful, flexible gift card

Team Appreciation & Informal Perks

Treat remote or office teams to coffee catch-ups, Friday lunches, or informal morale boosters.

Virgin Incentives Supports the GCVA #GiftCard500 Campaign

Backing the #GiftCard500 Campaign for Higher Tax-Free Staff Rewards

As an active member of the Gift Card & Voucher Association (GCVA), Virgin Incentives is proudly supporting the national #GiftCard500 campaign. We are actively lobbying HM Treasury and the UK Government to increase the HMRC Trivial Benefits allowance from its current £50 cap up to £500 per gift.

What is GiftCard500?

The #GiftCard500 campaign is an industry-wide initiative led by the GCVA representing the UK gift card and incentive sector. The campaign advocates for modernising tax-free gifting rules to better support UK businesses and workers.

Why Campaign to Increase the Limit from £50 to £500?

The current £50 trivial benefits threshold was established in April 2016 and has
remained frozen for nearly a decade. Due to cumulative inflation and cost-of-living
pressures, £50 no longer holds the purchasing power it did when the exemption was first introduced. Raising the cap to £500 reflects modern economic realities and gives employers a far more impactful way to appreciate their teams.

How #GiftCard500 Benefits Businesses & Employees

• For Employers: Enables businesses to gift meaningful tax-free rewards (£100 to £500) without triggering heavy P11D reporting or payroll tax surcharges, saving businesses money compared to traditional cash bonuses.
• For Employees: Delivers substantial financial relief towards household essentials, groceries, home improvements, or family experiences during key life moments.

Current £50 Rules (Brief Summary)

Under active HMRC legislation, trivial benefits remain capped at £50 per gift (inc. VAT), must not be paid in cash, cannot be linked to work performance/targets, and cannot form part of a salary sacrifice contract.

⚠️ IMPORTANT TAX COMPLIANCE NOTICE: Current Law vs. Proposed Campaign

• Current Tax-Free Allowance: £50 max per gift (Statutory Law under active HMRC rules)
• Proposed Campaign Limit: £500 per gift (Industry Campaign Proposal undergoing lobbying)

Note: All Leisure Choice Gift Cards purchased today must strictly adhere to the current £50 limit per occasion to qualify for 100% tax and National Insurance exemption.
